Terms of Service

All orders received by IT Yuda Ltd through our online store at ityuda.com or via email are subject to review and acceptance by IT Yuda Ltd. As all prices are subject to change and stock availability can fluctuate, your order may not be accepted or we may have to communicate these issues to you after you place your order. By submitting an order with IT Yuda Ltd it is assumed that these Terms of Service have been accepted by you and that they have been read and accepted in their entirety.



Payment Terms  


IT Yuda Ltd accepts a wide range of payment options to help facilitate doing business with our company. We accept all major credit cards, PayPal, Bank Transfer and in many cases Credit will be made available upon application. The Company is under no obligation to issue credit and will only do so if all credit criteria and checks have been met. Should a form of payment be declined for any reason then IT Yuda will endeavor to inform the customer at the earliest available opportunity and advise on an alternative course of action or payment method. No orders will be shipped under any circumstances unless payment has been satisfactorily received.



Order Acceptance Policy

The completion of an order through our website or other means of communication does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. IT Yuda reserves the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. An order will only be confirmed once payment has been processed and the stock allocated.



Typographical Errors

If there is incorrect pricing, images or information displayed on our website or communicated by other means due to a typographical or image error; or information provided by third parties that is incorrect IT Yuda Ltd have the right to refuse or cancel any orders placed for product listed at the incorrect price. IT Yuda Ltd shall also have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, IT Yuda Ltd shall immediately issue a credit to your credit card account in the amount of the charge. 



Returns Policy and 30 Day Money Back Guarantee

IT Yuda Ltd will gladly accept Returns if you are not completely happy with the service or product you receive. The company must be notified within 30 days from the date of order and the goods must be unopened and in a resale condition. Any shipping charges, credit card surcharges or any other charges relating to the order will be at the expense of the customer. Depending on the circumstances of the return there may also be a 20% restocking fee applied. Any products that are opened or damaged will not be accepted unless they were signed for as damaged when delivery was made. Returns are only accepted after the completion of an RMA by the IT Yuda Account Manager in charge of the order. Any Returns without the official RMA number will not be accepted.

Warranty

Every product shipped by IT Yuda is covered by the company's DOA policy detailed above. After the expiration of this policy then the product is covered under the manufacturers warranty (please check duration for details). 

Although not liable for any faulty products in this instance it is part of IT Yuda Ltd's commitment to superior service that we will help facilitate the resolution of any problems pertaining to warranty issues with all the manufacturers we supply. Please ask your Account Manager for further information.



Shipping and Handling

We keep Shipping charges to a minimum and offer Free FedEx Ground Shipping for all orders in Canada, USA and Europe over $500 in total. There is a flat rate of $20 applied to all orders under $500 placed with us. We  also offer the option of expedited shipping which will vary according to the product and required timed service. Please contact your relevant IT Yuda Account Manager for further information.



Risk of Loss

If the Customer provides IT Yuda Ltd with Customer's carrier account number or selects a carrier other than a carrier that regularly ships for  IT Yuda Ltd, title to products and risk of loss or damage during shipment passes from IT Yuda Ltd to Customer upon shipment from IT Yuda Ltd's facility. For all other shipments, title to products and risk of loss or damage during shipment passes from IT Yuda Ltd to Customer upon receipt by Customer. Notwithstanding the foregoing, title to software will remain with the applicable licensor(s) and Customer's rights therein are contained in the license agreement between such licensor(s) and Customer. IT Yuda Ltd retains a security interest in the products until payment in full is received. Customer will be responsible for all shipping and related charges. 



Limitation of Liability

In no event shall IT Yuda Ltd or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. Some localities do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.



Interpretation



These terms of service shall be interpreted under and governed by the federal laws of Canada, without giving effect to conflicts of law rules. Headings used in these Terms of Service are for convenience of reference only and are not intended to be part of, or to affect the meaning or interpretation of, these Terms of Service.

No Modification

Any additional or altered terms attached or adhering to an order shall be null and void and without effect, unless agreed to in writing by IT Yuda Ltd. These terms of service may not be modified, altered or amended without the written agreement of IT Yuda Ltd.
